Quotations
are valid for 30 days only.
If
the whole document is not made available at time of quotation I only
provide a non-binding estimate of the total price, based on the
materials seen and the client's description, which will be confirmed or
amended once such materials are presented.
Any additional work will be charged separately. If a
translation presents latent difficulties of which neither
party
could have been reasonably aware
at the time of offer and acceptance, the agreed fee may be renegotiated.
Confidentiality
The
translator shall at all times do his utmost to protect and keep safe
the materials provided by all clients, however, documents for
translation shall not be deemed confidential unless expressly stated by
the client.
All documents supplied by the client will be held
by the translator at the client's risk. The translator will not be
responsible for the consequences of any loss or damage thereto.
Third
parties may be consulted over specific translation terminology queries,
provided that there is no disclosure of confidential material.
If
the client does not confirm that the translation is confidential, the
translator shall have the right at no cost to show the translation to
potential clients.
Deadlines
The translator undertakes to complete the translation to the best of
his ability and within the period specified by the client.
Any
adjustments to the assignment by the client during the course of its
execution will permit a renegotiation of the delivery date.
Should
it appear that it will be impossible for the translator to ensure
timely delivery due to exceptional circumstances, he will notify the
client immediately.
In the unlikely event that a deadline is
missed, the client shall be entitled to cancel the agreement
unilaterally if he is no longer able to wait for his order to be
fulfilled. In this case the translator shall not be subject to any
penalties or liable for any compensation. If the client agrees to wait,
they may renegotiate the conditions of continuing
engagement.
Errata
Translation
involves elements of subjectivity and judgement and, accordingly, the
client acknowledges that one translation will differ from a translation
of the same material done by another translator.
The translator
undertakes to perform translations accurately and thoroughly within his
ability and areas of expertise, but will not be held liable in any way
for any direct or indirect damages resulting from any documents he
produces or services he provides.
Following completion of a
project, the translator will rectify at no charge any errors or
omissions that are his fault where the errors and omissions amount to a
maximum of 5% of the fee value of the project, so long as such issues
are raised by the client within 10 working days of their receipt of the
completed assignment.
Copyright
It is the responsibility of clients to ensure that the materials to be
translated do not contravene copyright laws.
Copyright
of the translation itself remains the property of the translator until
receipt of full payment for translation services
provided.
When
the translator assigns the copyright and the translation is
subsequently printed for distribution, the client must acknowledge the
translator's work on the first or last page of printed materials and at
the head or tail of film subtitles.
If a translation is to be
incorporated into a translation memory system the translator shall
license the use of translation for this purpose for an agreed
fee.
